Terms and Conditions

The Super Investor (Aust) Pty Ltd is an authorised representative of DCB Nominees Pty Ltd [abn: 42 093 207 464 - AFSL 230765], and is authorised to provide general advice in relation to securities on behalf of DCB Nominees.

In these Terms and Conditions, a reference to 'The Super Investor' or 'we' or 'us' is a reference to The Super Investor (Aust) Pty Ltd, abn: 16091371461, of Suite 1, 9 Park Avenue, Coffs Harbour NSW 2450 - phone 612 6658 1400 - and any of its 'related bodies corporate' [as defined by the Corporations Act 2001].

By purchasing you signify your acceptance of these Terms and Conditions.

Payment Schedule - The Super Investor Report is made available to you for a minimum of 12 months. If you accept our special offer to pay by the month, you agree to a minimum of 12 consecutive monthly payments. Monthly payments are processed automatically to the credit card you have nominated and you agree to have sufficient funds available to make the required monthly payment. Should your credit card details change you must notify us immediately so that payments are not interrupted, missed or in any way fail to be made to us. If you fail to pay within 7 days past the due date of a scheduled monthly payment, and no alternate arrangements to pay have been agreed upon with us, we reserve the right to recover the amount overdue, and you are responsible for all debt collection costs incurred by us.

Cancellation and Renewal of Monthly Payment Plan - Cancellation of the monthly payments is not possible within the first 12 months. After the initial 12 month term we will continue to bill you on a month by month basis until you notify us that you wish to terminate your subscription by giving notice via email to admin@thesuperinvestor.com.au.

Disclaimer - We [including any employee, agent, or representative of The Super Investor (Aust) Pty Ltd or DCB Nominees] offer no guarantee or warranty, nor will we accept responsibility, in any way, for the accuracy, reliability, timeliness or completeness of any advice, information, or data in The Super Investor, and neither we, nor any of our employees, agents or representatives will be liable to any person for any loss or damage, arising as a result of any action taken on advice, information, or data in The Super Investor. To use The Super Investor you must accept full responsibility for any action you take.

Important Warning - The Super Investor is produced for the general information of investors, without any regard whatsoever for any individual person's needs or objectives. Indeed, the content may not be appropriate for you. Reliance on the advice, information or data is at your own risk.

Confidentiality - You agree to keep all information confidential. You agree not to pass on to any other party any material or information that you obtain or have access to as a result of your purchase of The Super Investor, and you acknowledge that such information is the proprietary information of The Super Investor (Aust) Pty Ltd. You agree that a breach of this agreement will be harmful to the business interests of The Super Investor (Aust) Pty Ltd and that monetary damages alone would not be a sufficient remedy for a breach. In addition to any remedy which may be available in law or equity, The Super Investor (Aust) Pty Ltd is entitled to seek interim, interlocutory and permanent injunctions or any of them to prevent breach of this agreement, and to compel specific performance of it.

Prohibited from Purchasing - If you provide investment advice, education or services of any type, or you are associated with any party that does, you are NOT permitted to purchase The Super Investor. If you are in any way in competition with us, or associated with a party who is, you cannot subscribe to The Super Investor.

Risk Warning - Past results are not considered a reliable guide to future results. Future outcomes are unknown. Investing can result in financial loss.

Passwords - You agree not to disclose your passwords to any other party.

Individuals Only - Only individuals can purchase The Super Investor. It's one person only per purchase. Receipts can be issued in the name of your SMSF, however each unit is for one person only.

Refund Policy - There is a quality assurance money back guarantee, valid for 14 days. 'Quality assurance' means that to receive a refund, you must establish that a misrepresentation was made, or establish that there is an ethical or academic fault with the service.

Changes - The content of the Report may be changed without notice.

Trade Marks - You may not use, modify, or permit the modification, of any of the trade marks appearing in The Super Investor.

Indemnity - You agree to indemnify and hold The Super Investor (Aust) Pty Ltd and DCB Nominees, their employees, agents and representatives, harmless from any loss, claim, cost, tax, liability or damage [including legal costs on a full indemnity basis] suffered or incurred by itself, its directors, employees, agents and representatives, arising out of your use of The Super Investor, or any claim by a third party arising from an act or omission by you in connection with The Super Investor.

Entire Agreement - These terms and conditions constitute the entire agreement between you and The Super Investor (Aust) Pty Ltd, acting for DCB Nominees.

Governing Law - These terms and conditions will be governed and interpreted in accordance with the laws of New South Wales, Australia. If there is a dispute arising out of these terms and conditions, or your use or access to this website, litigation must be brought in a State or Federal Court in Sydney, Australia. By using this website, you consent to the exclusive jurisdiction of those courts.
